Florida Personal Injury Protection (PIP) Pays Your Medicals
The purpose of the Florida Motor Vehicle No-Fault Law is to provide for medical, surgical, funeral, and disability insurance benefits without regard to fault, and to require motor vehicle owners to acquire no-fault insurance coverage. Basically, the No-Fault Law requires motorists to have their own insurance to cover damages for personal injuries arising from non-permanent injuries sustained in a car wreck.This required insurance is called Personal Injury Protection, commonly referred to as PIP. In essence, an accident victim must look to his or her own PIP coverage for for compensation for injuries sustained in a car wreck. Under Florida No-Fault the victim cannot file a suit to recover damages against the "at fault" party unless if the accident victim suffered (a) loss of a body member, or (b) permanent loss of a bodily function, or (c) permanent injury other than scarring or disfigurement, or (d) significant permanent scarring or disfigurement, or (e) a serious non-permanent injury or (f) death. Except for automobile accidents occurring while the individual is on the job, PIP is primary coverage, providing certain statutorily mandated benefits to a class of persons designated by statute. F.S. 627.736(1)(a)-(1)(c).
